"Equitable Licences

  • Sponsor: Volkswagen Foundation (Germany)
    Duration: 2008-2010
  • Co-operation project with Dr Peter Tinnemann, Charité -Universitätsmedizin Berlin, Dr chem. Christian-Wagner-Ahlfs, BUKO- Pharmakampagne, Bielefeld.
  • The project examines the practice of technology transfer through patented research results from universities to industry. It asks how the responsibility of "public" research is reflected in its licensing policies. One aim of the project is to develop a set of model licences that can be used in the day-to-day work of technology transfer offices.

    • The starting point of the project was a legal opinion examining the question of the framework within which compulsory licences can be granted within Europe (spring 2008) in order to achieve price differentiation within Europe. The results of the legal opinion were discussed at the conference in October 2008 with international experts from academia and practice.

  • The project examines the national differences in the containment of the
    legal conflicts associated with the expansion of intellectual property in
    the various policy fields. The centre of attention is how
    the different legal systems deal with conflicts that were formerly
    shaped by the constituent elements (scope of protection) and the scope of protection
    of intellectual property rights, but have now lost their power to shape the law due to the
    extension of protection. The study
    currently covers 15 jurisdictions. The research method is
    comparative law and strictly orientated towards (constructed) cases (questionnaire).

Comparative property law"

  • since 2007 textbook project together with Prof. Dr F. Fiorentini, Trieste (I) and Prof. A. Clarke, London (UK).
  • Based on the teaching materials from my Hanse Law School courses (winter semester 2006/2007; 2008/2009), the project aims to produce a textbook for the emerging subject of "Comparative Property Law". It compiles case material in a problem-oriented (behaviour- and result-oriented) and comparative law manner and discusses principles, rationals and solutions of the individual legal systems.
  • Current: A joint "Team Teaching" with Prof. Dr Sjef van Erp (University of Maastricht) as part of the Hanse Law School, winter semester 2009/10, in which Prof. Van Erp will contribute his textbook "Comparative Property Law", which is currently being finalised, will drive our book project forward.
