Since 2 February 2025, the AI Regulation (KI-VO) has been in force, which obliges universities as operators of AI systems to ensure that their staff - including scientific staff and, in the case of mandatory use of AI in studies, students - have sufficient knowledge for the responsible use of AI. Monitoring by the BNetzA will begin from 3 August 2026. Although no fines are provided for violations of Art. 4 of the AI Regulation (Art. 99 of the AI Regulation), a lack of AI competence can be considered a breach of the duty of care, especially in the event of damage. The BNetzA therefore recommends careful documentation of the measures taken to demonstrate compliance. Universities must introduce binding, documented basic AI training for affected persons, whose responsibility cannot be passed on to external providers or lecturers. Implementation should be anchored technically (e.g. via LMS) and organisationally (e.g. in terms of use). The WP 5 working group of the DLHN project is working on the implementation of such training; initial content is already available for test implementation.
